1. Agreement to Terms

By downloading, accessing, or using the Pho AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the App.

2. Use License

Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to use and access the App solely for your personal, non-commercial use.

You agree not to:

• Modify or copy the App materials.
• Use the App for any commercial purpose.
• Attempt to decompile or reverse engineer any software contained in the App.
• Remove any copyright or other proprietary notations from the materials.
• Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

3. User Content

You are solely responsible for the images and any other content you upload or process through the App ("User Content"). You retain all ownership rights to your User Content.

You represent and warrant that:

• You own the User Content or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content as described herein.
• Your User Content does not violate privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.
• Your User Content does not contain any material that is defamatory, obscene, unlawful, offensive, or harmful.

We reserve the right, but are not obligated, to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.

4. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Pho AI and its licensors. The App is protected by copyright, trademark, and other laws of both the UAE and foreign countries.

5. Prohibited Activities

You agree not to use the App to:

• Engage in any activity that is illegal, harmful, or violates the rights of others.
• Upload or generate content that is sexually explicit, violent, discriminatory, or promotes illegal acts.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Attempt to gain unauthorized access to the App, user accounts, or computer systems or networks connected to the App.

6. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's operation or the information, content, or materials included therein. You expressly agree that your use of the App is at your sole risk.

We do not warrant that the results generated by the AI models will be accurate, reliable, or meet your expectations. AI-generated content can sometimes be unpredictable or contain artifacts. You can regenerate the image as many times as you want.

7. Limitation of Liability

In no event shall Pho AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of UAE, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
